Services Provided
Creative Services provides web development, design, digital marketing, SEO, hosting, and related IT services. We will perform services as described in individual project agreements or service contracts. Service specifications, timelines, and deliverables will be outlined in separate project proposals. We reserve the right to refuse service to anyone at our discretion.
Payment Terms
Payment terms will be specified in individual project agreements. Generally, we require an advance payment before commencing work. Invoices must be paid within the timeframe specified (typically 15-30 days). Late payments may incur interest charges and service suspension. All prices are in Indian Rupees (INR) unless otherwise stated. Prices are subject to applicable taxes.
Intellectual Property
Upon full payment, clients own the final deliverables created specifically for their project. Creative Services retains rights to pre-existing materials, templates, and proprietary tools. We reserve the right to showcase completed work in our portfolio unless otherwise agreed. Clients must provide only legally owned or licensed content for their projects.
Client Responsibilities
Clients must provide accurate information and timely feedback during projects. Clients are responsible for content accuracy, licensing, and legal compliance. Delays in client feedback may extend project timelines accordingly. Clients must maintain backups of their data independently. Hosting clients must comply with acceptable use policies.
Limitation of Liability
Creative Services is not liable for indirect, incidental, or consequential damages. Our liability is limited to the amount paid for the specific service. We are not responsible for third-party service failures or data loss. Clients must maintain independent backups of all critical data. We do not guarantee specific business results or outcomes.
Project Cancellation & Refunds
Project cancellations must be submitted in writing. Advance payments are non-refundable for work already completed. Refund eligibility depends on project stage and work delivered. Cancellation fees may apply as specified in project agreements. Unused hosting or service credits may be eligible for pro-rated refunds.
Warranties & Disclaimers
Services are provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service. Website performance depends on factors beyond our control (hosting, internet, etc.). We warrant that work will be performed in a professional manner. Specific performance guarantees must be outlined in separate agreements.
Confidentiality
We maintain confidentiality of client information and project details. Clients must not share proprietary tools, processes, or confidential information. Non-disclosure agreements can be signed upon request. Confidentiality obligations survive project completion.
Governing Law
These terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of Mumbai courts. Alternative dispute resolution may be pursued before litigation.
